Originality? Responsibilities?

Browsing the finalists for this year's Singapore Shorts Finalists (for the Silver Screen Awards), I was hit by this very familar sounding story synopsis.

It reminded me an awful lot about a comic I read way back in 2001. A single issue. Short story anthology series are all but dead in comics. The comics world is moving towards a larger format of trade paperbacks and original graphic novels. More and more comics are created with an eye towards a longer story.

That’s what makes the story I mentioned above all the more remarkable. This book, in the span of 22 pages, told a story that stuck with me. It made me reconsider the art form of comics, taught me something new about narrative storytelling and basically it just moved me. 3 years later, I can still remember it vividly and hence this silly post.

The single issue that did it all for me was Spiderman: Tangled Web #4: Severance Package. Yes, Spider-Man turns up in one panel in this story, and the Kingpin is a significant player. But Rucka and Risso deliver something that many readers have been looking for from Marvel: a non-super-hero, non-Marvel-continuity-reliant tale.

It's late at night, and the Cochrane household is slowly preparing for bed when the phone rings. Tom Cochrane picks up the phone and is told to turn on the TV. There is a news report playing about the capture of some illegal weapons worth "in the millions of dollars range." The camera briefly pans over the silhouette of a figure sticking to the wall, watching the arrest. Tom sighs, hanging up the phone with a "nice knowing you, too." His wife is concerned, and a little frightened, as Tom admits that the weapon sale was his job. He failed, and now he'll have to answer for that failure.

The phone rings again. This time it's Wilson Fisk. A man named Ritchie will be by to pick him up in about an hour.

As his wife watches incredulously, Tom goes to take a shower, shaving and putting on his best suit. He takes a minute with each of his boys, tucking them back in. He goes down to the kitchen with his wife begging him not to go. "He's going to kill you, Tom, you know that!" "Yeah," Tom says, "yeah, he is. Could I get a cup of coffee before I go?"

Tom slowly sips his coffee, while his wife begs him to fight back, run, go to the cops, anything. Tom refuses, telling her that this is what he signed on for. The family is set financially. All too soon the doorbell rings, and its Ritchie. Tom kisses his tearful wife goodbye and leaves his home.

As Ritchie drives him, the two talk. Tom asks if that "Chinatown thing" got fixed, and Ritchie admits that it hasn't but that the Kingpin said he'd give him another chance. The car finally arrives at Fisk tower and Ritchie tells Tom he will escort him to the top.

"It won't be necessary, Ritchie." Before the startled kid knows what's happening, Tom bashes his face into the driver's side window, steals his gun, and blows his brains out. "There are no second chances, kid."

Tom walks through the empty lobby, taking the elevator up to the penthouse, and soon finds himself standing before the Kingpin. Fisk asks Tom if he knows why he's here, and Tom admits he saw the bust on the news. He also admits his guilt. He takes out the gun and Kingpin asks if it's Ritchie's. "After what happened with his Chinatown sale, I figured that's why you sent him." The Kingpin nods.

His nerve breaking for a moment, Tom asks the Kingpin for a favor: "please let my family live." The Kingpin doesn't respond, just orders Tom to move to the front of the desk. He tells Tom to attack him, staging the scene to make it look like he's defending himself. Tom does so, and the Kingpin quickly snaps his neck.

After dropping Tom Cochrane's dead body to the floor, the Kingpin pulls out a cellular phone. The man on the other end asks, "do I go in?" "No," Kingpin replies. "Leave the Cochrane family alone. They're done."

Doesn't it make for a fantastic short film? If anything, I'll be willing to bet my bottom dollar that this is the rough outline that 'Responsibilities' is set out with. Ugh. Does he actually think he'll get away with it? Hmmm. I guess apparently so. Hopefully Rucka is credited. Then again. Singaporeans. Copy and paste only. The End of LAWR as we know it

Legal Theory was disappointing. That's all I can say about it. Moo. Moots was quite... interesting. After I was done, I was actually hoping to go again. I didn't think my performance was good enough. Dammit man, I had alot of research done for nothing. Ugh. Kenna banged on Section 2(5) too. Oops. My bad. Sigh. Oh well. Though moots itself wasn't that bad (the experience when speaking), the prelude to moots was horrible. We practiced speaking in the dungeons...

Classroom

Yeah. Those are the stat people. All of whom did better than me. Junren had his once in a lifetime dissing of the judge in "your honour... your honour... YOUR HONOUR!" Heh. Azmin had his whole pen and litigator without the vocab routine... and well. Cassandra I have no idea how you fared. Nobody told me. Hmmm. All I did was to piss off the judge when insisting that Rattrays was decided on a bare nominee... (IT IS! I SWEAR! p.382 ln22! IN YOUR FACE SIOBHAN!) and also pissed my nice opponent yinbing off when I mentioned that she had misread her Field's case. Whoops... Sorry! (She rebutted me by saying I misread Lambly. Which wasn't entirely true but the judge had already refused my stand on bare nominee. So it doesn't matter~ Sigh - I totally misread Nisshin though. Heh)

Followed by my counsel for the resepondant for common law, grace~ Obviously we were famished by the time we were done. I skipped the morning lecture and also my final contract tutorial. Sobz. Sorry A/P Teo. But if I went, I'd have been brain dead for moots. Dinner was subsequently at Brewerkz. Heh.

Grace was extra. Went back PGP to change. Ended up making us look like we were pedophiles. 3 guys in white shirts and pants with a little girl in a skirt and tee. It was pretty funny. The waitress was pretty funny too. Spilled water all over the table. But well. It's hard waitering in the first place. No handphones or clothes wet so no harm done I suppose.

Food

This was what we ordered. Plus Golden Ale. Fingers not included. I loved the breadstick sauce. The white one. I think they had potatotes inside. But I could be wrong. As people usually tell me I am. Quite a nice way to celebrate the end of a module. :)

Ma moo mee ma moo mee ma moo mee, maaaa moooo meeee

It's moots. In 2 hours. Yeah I know. Plenty of you have finished already. Same issues as moi. I'm like. The last one for my issue. On the last day. So. I'm really paranoid see. Paranoid that they'll accumulate everything and last minute bang me.

The question that has been on everyone's minds since 11:15pm would be... will Tsunamis strike again after the 8.2/8.5 quake in Sumatra? Will it cause the deaths of millions again? Will it flood Bangkok and Malaysia? Will Singapore eventually succumb to the quakes despite us sitting on the middle of a plate? Will we eventually have to build earthquake resistant homes? Will China manufacturers rejoice by producing more of the Tsunami wristbands from last year's tsunami craze? Finally, will I find food by 2:30am to feed my hungry tummy?

The answer to all the questions above are a resounding: Maybe. (Except the last one. I've got cup noodles~ Wahoo! Certainty!)



But before that, it's interesting how fast Channelnewsasia updated their site. Apparently the 1:30am update said that the epicentre was located on the island itself between Medan and Padang. But they took it down at 1:50am and changed it to 'the tremor struck between the offshore isles of Nias and Simeuleu, 33 kilometres under the sea.'



Similarly, the scale was changed from 8.5 on the richter scale to 8.2. Thus we could see the contradicting scales all over MSN.

The quake was close to the epicentre of a magnitude-9.0 seismic thrust which struck on December 26, throwing up a tsunami that killed more than 273,000 people around the Indian Ocean. Here I've included a nice picture stolen off the net last year which depicted the actual site of the Dec 26 tsunami.

Sumatra

Try finding the new epicentre. I have no idea where. But it's generally there. The tsunami created by the Dec 26 earthquake reached India and Sri Lanka in about four hours. So since it started at 11:15pm... 4 hours later would be around 3:15am. Ah well. You'll all probably only read this tomorrow.

Question: When is a day not a day?

Answer: When it's a day decreed by the KR Hall Admin.

Observe. This sight greeted me 2 weeks+ ago when I stepped into the KR Eblock 2nd floor toilet:

Hmmm. All 3 shower cubicles were closed. For how long? Let's check out the sign shall we...

Ah. It says that the shower room will be closed 'today' for repairs. Alright. Justified. Closed 'today' for repairs. No problem.

Except it has been 'today' for the past 2 weeks+.

Is it just me? Or does that sign magically refresh itself at the stroke of midnight everynight? That's quite amazing. I'd wish for the power to extend a day to 2 weeks and counting too. Think of the possibilities...

Anyway. It's bloody irresponsible for Hall Admin to just paste this and hope that the shower room fixes itself. At least find a goddam plumber. Or make it known that it would be closed for an extended period of time. Like say a month. Seeing the sign gets my hope up every single day. But then... let's me down again.

It's kinda like the phrase by Russell Peters... "Somebody gonna get a hurt real bad... course it always said somebody. He never said it was you. But you knew it was you. But it gave you this hope... Somebody."

MRT + Shoe = Disaster



Well, it's a little late blogging about this. But I just got back from xiaxue's site (which Tenny insisited I should check out via his MSN nick because she interviewed him regarding his toys...) and was a little pissed at her attitude towards the poor guy whom was picking up his shoe. Sure. It's easy to say now that the guy's dead what he should or should not have done. Anyway the papers today cleared it up la. He apparently slipped and fell. How again. We dunno. How did the camera not tape the entire progress? We dunno. But I suspect it's the same reason why I can speed past the speed cameras at 120km/h and not get caught. Yet.

I guess in the event that a guy actually falls onto the tracks, the onus of saving him not only lies on himself, but also on the bystanders I presume. Since he was unable to climb up the tracks, the amazing question now would be... why didn't anybody press the big shiny button to stop the train? With a platform full of commuters, I'm sure at least 30 saw him and around 10 were in proximity to the nice shiny buttons ya?

But then again. There's also a nice shiny red sign that says fine $5000.

I guess that explains alot.

Court of Appeal? Bah. Lim Poh Lye? Bah.

It started off as a smashing day. 3hrs of sleep, trying to dress appropriately for court then upon reaching the public gallery, finding that it didn't matter if you wore shoes or chap chap slippers. The judge can't see anything but your torso. In fact, I'm sure it didn't even matter if you wore pants. (To facilitate stab wounds to the thighs, 2 on the left, 5 on the right) But I guess nobody dares to try hur...



Anyway, it seems that the PP lives in a different timeline as us. For him, a 10 minutes statement of facts can last up to 1/2 hour. Or more. (I wasn't keeping count) What I do know, is that in court, it IS appropriate to cite a truckload of cases just to submit ONE point. Furthermore, one has to give a full summary of facts of each individual case to educate the unlearned judge unless he says otherwise. What surprised me was that the PP avoided the microphone. Instead, relying on his (not so) powerful voice to assert the judge that Lim Poh Ley should be sentenced under 300(c). I believe he had succeeded. Because I saw physical evidence that the judge was so fascinated by the PP's arguement that he was leaning forward on his high and mighty seat in all eagerness to lap up every word the PP said.

Though the PP was bad and couldn't be heard at all, the Defence for the 1st respondant (Lim!) was worse. He could be heard, coz he used the microphone, but made no sense. I will always remember this day in court because if you thought that our practice moots were bad, well... let's say you can still earn big bucks litigating. "Stabbing when the leg is moving.. very hard to intentionally cause stab wound #2. The leg very long. Got thigh and knee and calf...very long... moving.." That was probably his entire 10 minute point on why the stab wound #2 which caused death was unintentional. He said nothing else!

The Defence for the 2nd respondant was better in that he was clear. but he was like churning out one textbook example after another. He even cited Michael Hor! (Prononced w-hore~ oops, no offence~) But from his his examples and layout of his argument, it really seemed like he had consulted the latest Chan Wing Cheong, Ramraj and Michael Hor's textbook in preparing his submissions. Wonder if he bought it at $160. In all, the actual Court of Appeal was pretty boring. The judges didn't ask any relevant mind-boggling questions or try to make the Defence look stupid. He pretty much did that for himself. Heh.

The case itself I presume had the most number of 'viewers' today in court. Namely, us silly year 1 law students.

A brief summary of facts:-

The two accused, Lim (40+) and Koh (30+), together with a third man, Ng (still at large!), planned to rob the victim. They would abduct the victim in his car and force him to sign some cheques. They would then draw the cheques, drug the victim, leave him in his car, and flee. On Ng’s suggestion, they brought knives along to threaten or coerce the victim.

On 2 April 2004, the trio met up and abducted him in his car as planned. Whilst driving, they got hold of the victim’s chequebook, and forced him to sign several cheques. Throughout the journey in the car the victim made several attempts to escape. To prevent escape, the trio assaulted him. Lim stabbed the victim’s legs. The victim subsequently died. There were a total of 7 stab wounds to the thigh, 2 on the left, 5 on the right with stab wound #2 being the fatal injury.

They were charged under 300(c) but got reduced to one of robbery with hurt under s 394 of the Penal Code.

The High Court had referred to Tan Chee Hwee in making the decision of reducing the charge. The PP pushed for the objective Virsa Singh approach whilst the Defence kept citing Tan Chee Hwee and a string of other recent cases to show that the subjective approach had to be taken. The court accepted the argument that the stabbing of the leg to prevent escape was intentional, but it was done accidentally as in Tan Chee Hwee and hence the charge of murder should be put aside. Furthermore, there was no intention to kill. Plus no common intention on Koh's part to kill.

Honestly, I personally feel that the judgment was too light. 20 years plus 24 strokes of the cane for Lim and 15 years and 12 strokes of the cane for Koh. I prefer the objective approach of the culprits being guilty of murder just for causing the injury which resulted in death. Though an eye for an eye isn't very nice, but it was appropriate in such a circumstance. Let me explain as best as a year one Cow plus student can.

Poor Mr Bock (the victim!) was abducted. In other words, (To carry off by force; kidnap.) kidnapped. To be charged under the Kidnapping Act Cap 151 by itself and convicted would carry the death penalty. Was the PP too lenient in not considering this charge? Then came the question of whether the injury was supposed to be judged by the objective and subjective approach. Should it really be judged by the subjective? I will not go into the cases nor elaborate on the approaches becaue you'll probably read it better in the judgement when it's out (actually because I think I cannot construct an argument well le. That's why got Cow plus). Instead, we can discuss the facts. Fact #1: Kenna stab 7 times. <-- no intention to kill? Fair enough. Didn't know stabbing a person in the leg would cause such death, also fair enough. Fact #2: Locked up in the trunk of the car and deposited at a multi-storey carpark after being tied up and with chemicals in his eyes. <-- no intention to kill? I think not. Even though let's say he doesn't die from the 7 stab wounds inflicted. He would have suffocated to death. It was immaterial that he was found shortly after. (but dead from excessive loss of blood) The fact was that he was left for dead. Does that create an intention? CAN this create an intention? Then again, why should the intention be formed before the infliction of the injury and couldn't the act of leaving him for death construe the intention to kill? If they really have no intention to kill, might as well kick him out on the street albeit deserted street he got a higher chance of being found right?

This is how I *think* la. Quite unjust to get away with killing another person right? Which is why thinking this way, I get a Cow plus. Ah well. Sucky sucky.

Visually: Lim Poh Lye the 'murderer' (ok, robber cum accidental killer) had this look... very fierce (You play with me? Now I play with you!). He reminds me of an actor on TV. The uncle uncle one. Plus their memorials are damn big lah. They referred to up to 6 volumes (or more). Each volume had like 600+ pages. Then still got color photos of the victim's stab wounds. Wooo. We should really take more pictures in Thailand. (Save Tatap people!)

Therefore, I believe they should hang (for the above stupid reasons that I thought of... Errr... Fair, Just and Reasonable?). Save government resources and taxpayers money in running the prison too. Then again. Moo.

Finally, I managed to find this little post on the crime library website. I'll just copy and paste it here. But take it with a pinch of salt as it's an online forum. But if it's true. Well... quite sad if true:-

A planned robbery cum kidnapped of businessman Mr Bock Tuan Thong after court trial to pass verdict of coldblooded murder to 20 yrs with 24 cane and 15 yrs with 20 cane? Pls remember it was happened in our Singapore in broad daylight where more than 60 witnesses witness the cruelty of both man stabbed the poor old man and leave him at back of car boot to justify and said not murder. How can our law be justified in this way and it will bring to the public a very bad impression that if if happen to see through what the law covered, "You can escape death" From the first trial to the final verdict, the two murderer trying to cover up lot of untrue stories as the dead cannot speak. I would like to announce to the public to have your say about this case. I would like to hear more justice to be seen, frankly speaking the death person was my beloved brother in law who was filial to parents, loving to brothers and sisters and like a father to us as both our parents passed away. He also generously donated and helped friends to overcome difficulties without fail but last yr 2004 on April the 2nd, friend of him together with the other 2 plotted against him and lead to his death. A life of a good man struggled through yrs of hardship just prepare to have his retired yrs ahead had been murdered, died so cruelly at the back of car boot with lot of bruises, cut and punched with blood stained over the car boot. This tragedy only lead to the 2 murderer 20/15 yrs. How can this case answered to the public, pls have your say! I always proud of Singapore even my brother in law said that our country are safe to live but he died in the hand of the "safe country" in the broad daylight where the three of the murdered never put Singapore law in their brain but put law in their own hands. Pls friends, the whole trial the deceased as described by the murderer that he was very obliging adhere to what was told to do but they killed him at last but stories was told that they only want to rob but not killed. Verdict should not be like that to show the public what our law really are!

Posted on the day of the verdict. So how? Subjective or Objective approach?! It's sad that in applying the law, we neglect to consider the feelings of the victim's family. Sigh. Is this law?

I managed to spend some money.

I am so slow.

It's 8:37am and I've been sitting here at this table since 5pm straightening out my issues for my re-write. It's quite sad to discover that after changing a majority of my arguments, I'll have to re-write even more of my memo. As a result, I'm only 1/2 way through my stat issue. This is very bad. I vow to be done with my stat issue within 2 hours.

Password, Schmuzword...

I woke up this morning to this horrible window:

That meant that I could access the net, but could not log on to MSN as the connection in my room is quite cock one. So I spent the greater part of the day trying to figure out what went wrong. I recalled just a day prior, my printer refused to print. After kicking it around and in the process bruising my toe, I realised that the bloody USB cable was loose. Ouch.

Hoping that it was just another silly error on my part, I tried to resolve it through non-violent means this time. Without success. Finally, I gave in and changed my IVLE login password. Still cannot. Then I tried to change the password in the VPN login to reflect the new password in the event that I was stupid. Still it didn't work. Finally, I downloaded VPN again. Input the new password, and it worked.

I need better instructions.

I'm impressed

I went into Robots thinking that it was gonna be crummy. I mean. Look at the character designs. Look at the toys. They're so ugly nobody will ever wanna buy them. Period.

But the show itself was totally unlike anything I ever thought it would be. Which is good of course. Let's see. We've got Halle Berry, Mel Brooks, Drew Carey, James Earl Jones, Jay Leno, Ewan McGregor and Robin Williams just to name the famous few.

I had no time to complete this review. And will be blogging it up anyway since nobody reads old blogs. Hah!

Bottom line. I loved it.

I humbly submit that the pronounciation for coupon is wrong.

Coupon should be pronounced 'Ku-poon'. Really. I've been saying that for the last 20 years. I believed it was right all along. Please do not take this magical pronounciation away from me. Even 7-11 agrees with me when I went in and asked for 4 'Ku-poon booklets, 2 of each color'. If they understood me, what's wrong? Sigh.
